Greetings from cheapcruisefare.com (the "Website"). This website is only offered to help consumers obtain travel-related information, check the availability of travel-related products and services, make valid reservations, or conduct other business with travel suppliers. The terms CruiseShipCenters International Inc., its subsidiaries, and corporate affiliates (collectively, the "CF Companies") are referred to as "we," "us," "our," "cheapcruisefare," and "CF." The phrase "you" refers to the client who visits the Website and/or makes a reservation via our travel consultants or on this Website.
This Website is provided to you subject to your acceptance of all of the terms, conditions, and notices listed below (collectively, the "Terms of Use" or "Agreement") without alteration. Below you read the Terms of Use as they include crucial information regarding liability limitations and arbitration as an alternative to litigation. Additionally, read our Privacy Policy, which is referenced in this Agreement and regulates how you use this Website.
You acknowledge that the Terms of Use that are in effect at the time will be applicable if you access or use this Website, make any reservations for travel-related goods or services, or get in touch with our travel advisors. If you disagree with the Terms of Use, please do not use this Website or book any reservations through our travel consultants. Your continued use of this Website is contingent upon your acceptance of any changes to the Terms of Use, which are subject to change at any time by CF.
PROCEDURE OF USING WEBSITE
By using this Website, you agree to the following terms:
At any time and for any reason, including but not limited to a violation of these Terms of Use, we reserve the right, at our sole discretion, to prevent anyone from using this Website and the services we provide.
DISPUTES
As part of our dedication to client satisfaction, we will work to address any issues or disagreements you may have. However, you can pursue claims as described in this section if we are unable to help.
By contacting Cruisefares Customer Support or 1-877-787-7186, you consent to give us the chance to address any disagreements or claims pertaining in any manner to the Website, any interactions with our customer support representatives, any services or goods offered, any representations made by us, or our Privacy Policy ("Claims"). You may seek relief through arbitration or in small claims court, as described below, if we are unable to resolve your claims within 60 days.
With the exception of small claims court, where you may bring claims individually if you are eligible, all claims will be settled through binding arbitration rather than in court. This covers any claims you make against us, our affiliates, travel agencies, or any businesses that sell goods or services to us (receivers of this arbitration agreement). Regardless of whether previous iterations of the Terms of Use required arbitration, this also covers any Claims that surfaced prior to your acceptance of these Terms of Use.
Arbitration does not involve a judge or jury, and the court has limited authority to review an arbitration award. An arbitrator must abide by and enforce these Terms of Use just like a court would, but they can also grant the same damages and relief on an individual basis as a court, including statutory damages, attorneys' fees, and costs.
The American Arbitration Association (AAA) will conduct arbitrations following its rules, which include the AAA Consumer Rules. Except as specified in this section, the AAA's rules will apply to the payment of all filing, administration, and arbitrator fees. We will pay the arbitrator's fees and reimburse you for the filing fees you paid to the AAA if the total amount of claims you seek is less than $10,000. You have the option of having the arbitration take place in person in your home state or at another mutually agreed-upon location, over the phone, or based on written submissions.
To initiate an arbitration process, you must write to "cheapcruisefare Legal: Arbitration Claim Manager," located at Expedia, Inc., 333 108th Ave N.E. Bellevue, WA 98004, requesting arbitration and outlining your claims. The email address or street address you have provided will be used to notify you if we request arbitration against you. To obtain the AAA's rules and filing instructions, visit www.adr.org or give them a call at 1-800-778-7879.
All claims resolution procedures will be handled individually, not as part of a class, consolidated, or representative action. Each of us forfeits any right to a jury trial if a claim is decided to proceed in court rather than through arbitration. This agreement is governed by federal arbitration law and the Federal Arbitration Act. Any court with the authority to do so may validate an arbitration ruling.
RESTRICTED ACTIVITIES
All of the information and content on this Website, including but not limited to the cost and accessibility of travel services, as well as the infrastructure that supports it, are proprietary to us or our suppliers and providers. For travel or service reservations made through this Website, you may make limited copies of your itinerary (and related documents), but you agree not to alter, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, sell, or resell any software, products, services, or information obtained from or through this Website in any other way. Furthermore, you commit not to:
Any travel or service reservations linked to your name, email address, or account may be canceled by CF, and any related CF accounts may be closed, if your booking or account exhibits indications of fraud, abuse, or suspicious activity. In the event that you have engaged in any fraudulent activity, CF retains the right to pursue any required legal action, and you might be held accountable for any financial losses to CF, including damages and litigation fees. Please get in touch with CF Customer Service to dispute the cancellation of a reservation or the freezing or closure of an account.
RULES AND RESTRICTIONS FOR SUPPLIES
Your reservation and any travel-related products and services you choose will be subject to additional terms and conditions. These extra terms and conditions should be carefully read. You commit to following the terms and conditions of purchase set forth by any supplier you choose to work with. These terms and conditions may include but are not limited to, paying all amounts owed on time and abiding by the supplier's policies and guidelines regarding the availability and use of fares, goods, or services.
If full payment is not received on time, we reserve the right to cancel your reservation.
To pay for extra costs during your stay, certain hotel providers might ask you to provide a cash deposit or credit card when you check-in. This deposit has nothing to do with the money CF receives for your hotel reservation through the supplier.
Any expenses incurred as a result of relocation are not CF's responsibility.
You understand that before you can engage in a service or activity offered by a third-party provider, you might be asked to sign a liability waiver. You are aware that breaking the terms and conditions of any such supplier could lead to the cancellation of your reservation or reservations, the denial of access to the relevant travel product or services, the forfeiture of any money you paid for the reservation or reservations, and/or the debiting of your account for any expenses we incur as a result of the violation.
